By using www.muycollection.com you agree to be bound by these Terms and Conditions as set out by Ramon Zahra on behalf of MUY Collection (hereinafter referred to as the Company) trading under VAT Number MT1501-7608 with trading address at 7C, Midland Micro Enterprise Park, Triq Burmarrad, Naxxar NXR6345, Malta. We have set out the guidelines below to let you know what you can expect from us and see the terms on which you place your order. If you do not agree to these terms and conditions please do not use this website.
www.muycollection.com (hereinafter referred to as the ‘website’) offers an online shopping service. By using or submitting an order (and any subsequent orders) on this website you are agreeing to the terms that appear below.
Use of the website
1.1 To place an order on www.muycollection.com, you should be over 18 years of age, have a credit/debit card accepted by us in your name and you must ensure that the details provided by you on registration or at any time are correct and complete.
1.2 You must inform us immediately of any changes to the information that you provided when registering by updating your personal details.
1.3 Do not share your website password created upon registering on www.muycollection.com with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us by contacting our Customer Care Department (Email: info@muycollection.com) immediately.
Pricing & Delivery
2.1 In addition to the price there is a delivery charge of Three Euros and Ninety-Five cents (€3.95) for deliveries between Mondays and Fridays; and free delivery for purchases over Thirty-Nine Euros (€39.00); to any of the locality in Malta and Gozo.
2.2 Deliveries are from Mondays to Fridays, not including public and national holidays; with shipping estimates at 5-6 working days.
2.3 All prices quoted are inclusive of any Value Added Tax or other sales taxes applicable in Malta.
2.4 Please be aware that we may use third-party delivery services, including but not limited to couriers, transportation companies, etc.
2.5 We can change the prices on our site at any time without notice, but changes will not affect orders which We have already accepted.
Payment
3.1 Payment is to be effected via credit/debit cards.
3.2 Please ensure that the expiry date of your payment card is after the anticipated dispatch date of your order. Payment is taken at the point of dispatch for products and in the event that the payment card has expired we will be unable to take payment and/or fulfill your order.
3.3 You must pay for the Products (including all applicable delivery charges), and we will charge the card you have chosen to use to pay for your order once you reach the final billing page and submit your order. We immediately contact your bank or card issuer for authorisation to take payment from your account.
Website Maintenance
4.1 From time to time certain parts of, or the whole website may not be available due to maintenance work. We shall give as much notice as in the circumstances is reasonable and shall endeavour to carry out such works during the scheduled maintenance periods. Furthermore, the site or parts of it may not be available to circumstances beyond our control. We apologies for such inconveniences in advance.
Security Measures
5.1 Many Internet users are especially worried on the issue of security. We would like to set your minds at rest with the knowledge that our site is built with all the necessary security precautions.
5.2. The user is responsible for any telephone, ADSL, cable or other connection and Internet charges incurred while connecting to or using our website.
5.3 The user is responsible for all of the user's account and confidentiality of his/her passwords. We will suspend access or change access to user's account immediately upon notification by the user that the password has been lost, stolen, or otherwise compromised.

Any other use of materials on this website, including reproduction for purposes other than those noted above, modification, distribution, or republication, without the prior written permission of the company and/or its suppliers is strictly prohibited.

We disclaim all such representations and warranties, including for example warranties of merchantability and fitness for a particular purpose. Price and availability information is subject to change without prior notice. Neither the Company nor any of its directors and/or employees and/or representatives will be liable for damage of any kind arising out of the use of this website, and/or the merchandise purchased including but not limited to direct, indirect, incidental, punitive and compensatory damages. Furthermore, neither the Company's suppliers nor any of its directors and/or employees and/or representatives will be liable for damage of any kind arising out of the use of this website, and/or the merchandise purchased including but not limited to direct, indirect, incidental, punitive and compensatory damages.
7.2 Except as specifically stated on this website, neither the Company and/or any of its directors and/or any of its employees and/or any of its representatives and/or its suppliers and/or any of their directors and/or any of their employees and/or any of their representatives will be liable for damages arising out of or in connection with the use of this website. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
7.3 This site is created and controlled by the Company and/or its suppliers. The Laws of Malta will govern these disclaimers, terms and conditions, privacy policy, etc. without giving effect to any principles of laws. We reserve the right to make changes to our website and these disclaimers, including terms and conditions and privacy policy at any time, clearly referring to the respective version number and date amended.
Returns & Refunds Policy
8.1 Your right to return an item does not apply to certain products unless these goods are faulty on delivery or mis-described. Such items include Jewellery items; and/or Items which cannot be resold for health and hygiene reasons once unwrapped.
8.2 You have fourteen (14) days to return your items starting from the day you receive your order. This returns period starts from the date you receive your order. Returns are accepted strictly upon presentation of your receipt.
8.3 You are required to take reasonable care of items. Please return an item in its original and undamaged packaging with all of its components. If an item is returned undamaged in its original and undamaged packaging, we will offer you a Credit Note in accordance with our returns policy. Your rights under consumer legislation for these goods are not affected.
8.4 If you return goods or cancel your order under this clause 9 and we have already debited your card, we will give you a Credit Note for the sum received from you in respect of such goods.
8.5 If you wish to return a product, you can do so at any of our Stores in Malta. This will save you a second delivery charge for us to pick-up the previously-ordered product and simultaneously deliver the new product.
8.6 If you are a consumer, we are under a legal duty to supply products that are in conformity with the sale. Nothing in these terms and conditions will affect your legal rights in relation to products that are faulty or defective. If you consider that any product that we have supplied is faulty, defective or mis-described and it has not yet been used by you as a consumer, please notify us using the contact details on our website. You must return such products to us in accordance with this Returns Policy, and if the Products are faulty, defective or mis-described, we will as an alternative, offer you either one of the following options in respect of the defective products:
- Request for the repair free of charge; or
- Change with the same or similar models; or
- Grant a credit note depending on the customer’s preference.
The Sale Contract
9.1 Once you have placed your order, you should receive an e-mail from us acknowledging that we have received your order (but please contact us if you do not receive this e-mail).
9.2 Prices of all products must be paid in advance. For this reason, your order will be executed if it is pre-paid. After you submit your order, we immediately contact your bank or card issuer for authorisation to take payment from your account. We will not process your order until payment has been received in full. When the payment is received in full, we will confirm this to you by sending you a further e-mail confirming the Product is being processed ready for dispatch including any other product and/or delivery information. These terms & conditions, your order email and the dispatch confirmation email constitute an integral and essential part of the sale contract.
9.3 Once the above is done, you cannot cancel your order at any time, and thereafter the Returns Policy shall apply.
9.4 We offer you to buy a Product at any time unless the information about this Product is removed from our website or the relevant product page becomes unavailable.
9.5 You should keep a copy of these terms and conditions and your order for future reference.
Gift Vouchers
10.1 Gift certificates are not currently available for purchase online, if you have an existing gift or you would like to buy one you can visit one of our Stores.
Images
11.1 Images used on the site are for illustration purposes only. Most images fit the product description exactly, however in some rare cases product images may vary from the actual delivered product.
Other Terms
12.1 Nothing in these Terms and Conditions shall affect your rights as a consumer under the applicable law in the jurisdiction in which you are resident.12.2 If we have to contact you, we will do so by email or telephone, using the contact details you provided to us in your order.
12.2 We may change these terms and conditions from time to time. The terms and conditions that apply to your Sales will be those that are displayed on our website when you place your order.
12.3 By placing an order, you agree that we may transfer our rights and obligations under the sale to another organisation (including but not limited to delivery) and you give us a permission to do so.
12.4 The sale transaction is between you and us. No other person shall have any rights to enforce any of its terms.
12.5 Each of the paragraphs of these terms and conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
12.6 If we fail to insist that you perform any of your obligations under these terms and conditions, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
12.7 If we fail to comply with these terms and conditions, 2e are responsible for loss or damage you suffer.
12.8 We only supply the products for domestic and private use. If you use the products for any commercial, business or resale purpose, we will have no liability to you for any loss of profit, loss of business, loss of anticipated savings, business interruption or loss of business opportunity.
